1.1 These Terms of Service (“Terms”) form a binding agreement between: Questly Kft. (registered seat: 1065 Budapest, Révay utca 6. Fsz. 7., Hungary; Tax ID 32757402-1-42; Company Reg. No. 01-09-441027), operating under the brand “Kukta AI”, hereinafter referred to as “Kukta AI”, “Questly Kft.”, “we”, or “us”, and any natural or legal person using the Kukta AI platform (“User”, “Client”, or “you”).
1.2 “Dietitian” refers to an independent, licensed nutrition professional registered in the official Hungarian healthcare registry (kereso.enkk.hu) or an equivalent EU register, who provides nutrition-counselling services to Clients through the platform.
By creating an account or using Kukta AI, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any additional guidelines published on the platform.
3.1 Kukta AI provides a digital platform and payment infrastructure that enables Clients to: a) access AI-assisted meal-planning tools; b) connect with licensed dietitians; and c) purchase dietitian-delivered nutrition services.
3.2 Questly Kft. is not a healthcare provider and does not offer medical diagnosis or treatment. All professional advice is delivered by independent Dietitians acting within their licensed scope of practice.
3.3 Questly Kft. provides payment infrastructure that enables direct payments between Clients and Dietitians. Payments are processed directly to the Dietitian via secure third-party payment gateways (Stripe Connect). The Dietitian appears as the merchant on payment receipts. Questly Kft. facilitates the transaction and holds 50% of the payment as an application fee (escrow) to protect both parties, which is released to the Dietitian upon service completion or automatically after 14 days if no dispute is active. The Dietitian is responsible for issuing invoices to the Client.
3.4 Nothing in these Terms creates an employment or partnership relationship between Questly Kft. and the Dietitians.
3.5 AI-Powered Meal Planning a) Kukta AI provides experimental AI-assisted meal-planning tools that generate meal plans and shopping lists based on user preferences and available products. b) The AI system does not have access to user identifiers or personally identifiable information. Meal planning suggestions are generated without knowledge of your identity. c) Neither Questly Kft. nor Dietitians assume any responsibility for the AI's meal planning decisions, suggestions, or outputs. The AI tools are provided "as is" for informational purposes only. d) AI-generated meal plans are experimental and may not be suitable for your specific health needs, dietary requirements, or medical conditions. e) If you require a personalized meal plan tailored to your specific health goals, medical conditions, or nutritional needs, you should purchase a package or consultation from a licensed Dietitian through the platform.
4.1 By placing an order through the platform, you enter into a contract for digital services with Questly Kft., which includes the provision of the platform functions and the facilitation of the Dietitian’s service.
4.2 All prices are displayed in Hungarian Forint (HUF) or Euro (EUR) and include VAT where applicable.
4.3 Payment is processed via secure third-party payment gateways (Stripe Connect). Payments are made directly to the Dietitian, who appears as the merchant on your payment receipt. The Dietitian is responsible for issuing invoices to the Client. Questly Kft. facilitates the transaction and holds 50% of the payment as an application fee (escrow) to protect both parties. The escrow is released to the Dietitian upon service completion or automatically after 14 days if no dispute is active. If a dispute is opened, the escrow release is blocked until the dispute is resolved.
4.4 Refund requests relating to the platform’s performance must be submitted to Questly Kft. via peter@kukta.ai. Requests regarding professional advice quality shall be directed to the respective Dietitian.
5.1 Each Dietitian: a) must hold a valid professional licence and maintain it throughout their activity on Kukta AI; b) is solely responsible for the quality, accuracy, and legality of their professional advice; c) must maintain valid professional liability insurance; and d) must comply with all applicable professional and advertising standards under Hungarian and EU law.
5.2 Questly Kft. verifies Dietitians’ licences at onboarding and may conduct periodic audits. Dietitians whose licences are invalid, expired, or suspended may be immediately removed.
6.1 Users shall: a) provide accurate and up-to-date personal information; b) use the service only for lawful purposes; c) refrain from sharing or misusing other users’ data; d) acknowledge that any health-related decision should be made in consultation with qualified professionals.
6.2 You are responsible for maintaining the confidentiality of your login credentials.
7.1 Questly Kft. is the Data Controller under Regulation (EU) 2016/679 (GDPR) and the Hungarian Act CXII of 2011.
7.2 Personal and health-related data are processed only for: a) account registration and identification; b) matching with Dietitians; c) payment processing and invoicing; d) improving service quality; and e) legal compliance obligations.
7.3 Legal bases for processing include performance of a contract (Article 6 (1)(b)), legal obligation (6 (1)(c)), and consent (9 (2)(a)) for special-category health data.
7.4 Data are retained only as long as necessary for contractual or legal purposes, and stored on secure, EU-located servers.
7.5 Users have the right to access, rectify, erase, or restrict processing, and to lodge a complaint with the Hungarian National Authority for Data Protection and Freedom of Information (NAIH).
7.6 Detailed information is available in our separate Privacy Policy, which forms part of these Terms.
8.1 Questly Kft. provides the platform “as is” and does not guarantee uninterrupted operation.
8.2 To the extent permitted by law, Questly Kft. shall not be liable for: a) errors or omissions in Dietitians’ professional advice; b) indirect or consequential damages; or c) losses arising from factors beyond its reasonable control.
8.3 Questly Kft. remains liable for: a) its own gross negligence or wilful misconduct; b) breach of data-protection obligations; and c) misrepresentation of its services.
8.4 Nothing in these Terms excludes liability where such exclusion would violate applicable consumer law.
9.1 If you are an EU consumer, you have the right to withdraw from a digital-services contract within 14 days after purchase without giving any reason, unless performance has already begun with your express consent.
9.2 To exercise the right of withdrawal, notify us at peter@kukta.ai. If the service has not yet commenced, we will refund your payment within 14 days using the original payment method.
9.3 Where the service has commenced upon your explicit request before the end of the withdrawal period, you acknowledge that your right of withdrawal no longer applies once the service is fully performed.
All text, graphics, logos, software, and AI tools available on Kukta AI are the intellectual property of Questly Kft. and are protected under Hungarian and EU intellectual-property laws.
Questly Kft. may suspend or terminate your account in cases of breach, fraud, misuse, or legal obligation. You may terminate your account at any time by written notice to peter@kukta.ai; data will then be processed in accordance with our retention policy.
12.1 These Terms are governed by the laws of Hungary. 12.2 For users resident in the EU/EEA, mandatory consumer-protection laws of their country of residence may also apply. 12.3 Disputes shall first be attempted through amicable settlement. If unresolved, jurisdiction lies with the competent courts of Budapest, unless EU consumer-protection law grants you the right to sue in your home country.
13.1 Entire Agreement – These Terms and our Privacy Policy constitute the entire agreement between you and Questly Kft. 13.2 Severability – If any provision is held invalid, the remaining provisions shall remain in effect. 13.3 Notices – All notices shall be sent to peter@kukta.ai. 13.4 Language – In the event of any discrepancy between the English and Hungarian versions, the Hungarian version shall prevail.
